PAYMENTS, ALTERATIONS AND CANCELLATION CHARGES
MIG SOL accepts different types of payments for, and on behalf of the owner. For your convenience, you can decide to pay for your reservation online, by phone or through wire transfer.
Once the payment is made in full, a voucher will be available online for you to print and bring with you when you travel. The voucher will include all the details you’ll need to arrive at the property as well as contact information.
The initial deposit required to confirm a reservation to be paid at the time of booking (unless there are special conditions in place) is 25% of the total rent amount.
The balance is due 45 days before arrival.
For last-minute bookings (within 45 days of arrival) the full amount must be paid at the time of the booking.
In case of cancellation of the booking, even if it is substituted by another one, the following penalties apply:
– the initial deposit (25% of total rent) if the cancellation is made between booking time up to 46 days before arrival date;
– 100% of total rental price if the cancellation is made from 45 days to arrival date or in case of no show.
If the renter (the person in whose name the booking is made, to whom all correspondence is addressed, and, as such, is responsible for the rental) is unable to travel due to an official Lockdown in place at the time of the arrival with country or regional border closed in the country of origin or destination, starting from 14 days prior to arrival (14-0) only then will it be possible to cancel the booking with no penalty. The renter will, therefore, receive a full refund via the payment method used at the time of booking or a voucher for the same amount to be used for a future booking.
The renter that would like to cancel his booking(s) must communicate it to MIG SOL by sending an email to info@mig-sol.com. Cancellations that are communicated by phone call or any other way different from email won’t be taken into consideration.
The cancellation request(s) must be submitted by the same person who made the reservation(s) and the payment in the first place (credit card holder).
For any other alteration to the booking, or if the holiday-maker intends to transfer his/her booking to other persons, on the condition that the accommodation and the period do not change, the holiday-maker might be required to pay the amount of 50 Euros.
MINIMUM AND MAXIMUM RENTAL PERIOD PRICES
The minimum and maximum rental period can change for each property and this information can be found in the local policies or description of each vacation rental. There are properties that accept 1-night stays and there are villas that will accept only bookings for a minimum period of 2 weeks during the months of July and August.
MIG SOL reserves the right to modify prices on its websites at any time during any season but will never change the prices of reservations that have already been confirmed.
ARRIVAL AND DEPARTURE
Arrival and departure time are specified in the local policies of each property and in the voucher. In the case that there is no time indicated, arrival time must be between 4 p.m. and 7 p.m. and departure time must be between 8 a.m. and 10 a.m. The exact time of arrival must be STRICTLY advised to MIG SOL at the time of booking or subsequently thereafter, so that the owner or his/her representative can meet the holiday-maker on the spot (in the event that the exact time of arrival is not previously advised the following arrival time will be advised to the owner: 6.00 p.m.); the owner or his/her representative will wait for the holiday-maker for no longer than one hour from the advised arrival time.
Each change to the arrival date and arrival time must be advised to MIG SOL and be approved by MIG SOL at least 3 days in advance. In the case of unavoidable delay on the day of arrival, the holiday-maker must call the number listed on the voucher. Please call this number as soon as possible when problems arise in order to give the owner/agency time to react.
In the event that the owner or his/her representative are not available and it is not possible to advise the owner or his/her representative of a late arrival, in the event that the owner was not notified of a late arrival, or in the event that the owner cannot accept a late arrival, the holiday-maker alone is responsible for the cost of the overnight stay in a hotel. Reimbursement for any expenses incurred by the owner or his/her representative being obliged to make an unplanned displacement to the property can be claimed from the holiday-maker.
UPON ARRIVAL
On arrival the holiday-maker must present his rental voucher as well as his passport or identity card to the owner or his representative to enable them to proceed with their registration in accordance with legal requirements. For some accommodation the holiday-maker might be required to submit the documents for the registration before arrival.
SECURITY DEPOSIT
When the keys are handed over to the holiday-maker, the security deposit – as stipulated in the local policies published in the property page, in the booking process, and in the receipt and voucher – must be paid, in cash and in EURO (unless stated otherwise) to the owner or his/her representative. Such amount will be refunded at the end of the holiday minus any deduction made for damage caused to the property or for any additional costs that were not included in the rental price. THE OWNER OR HIS/HER REPRESENTATIVE CAN REFUSE ACCESS TO THE PROPERTY IF THE SECURITY DEPOSIT IS NOT HANDED OVER.
If a security deposit is not indicated in the property local policies, no security deposit will be requested. The holiday-maker is nonetheless responsible for any losses or damages caused to the property or its contents during the holiday. Should the holiday-maker decide to leave the property prematurely, the owner or his representative is authorised to refund the deposit to the holiday-maker by post (less any deductions for damages or any additional expenses) and only after having checked the inventory and the property in question. MIG SOL declines all responsibility in the event of a dispute between the holiday-maker and the owner regarding the deposit.
NUMBER OF PERSONS/SUBSTITUTIONS/PETS
The person whose name appears on the Voucher is the referent for the use of the property. When not stated otherwise in the local policies or description of the property the minimum age required to be able to book a vacation rental is 18 years old. The persons in the party (adults and children), duly registered by the owner/keyholder, must not exceed the number of sleeping places indicated in the property description page. In some situations exceptions are made in the case of infants (up to 2 years of age): this type of request must be made before booking, and it can only be accepted on the basis of the permits with which the accommodation is equipped. Any other exceptions are stated in the local policies published in the property description page. The substitution of persons during the rental period is forbidden unless previously agreed upon with MIG SOL.
Pets will be admitted in those properties where the respective symbols are shown. The holiday-maker is obliged to advise MIG SOL at the time of booking if he/she is bringing any pets, stating the number and size as well. Any costs relative to pets is specified in the local policies or description of the property.
It is compulsory that the holiday-maker supervise his/her pet(s) within the communal areas inside the property. When not stated otherwise in the local polices of the property, pets are not allowed inside the swimming pool.
CLEANING
The properties will be handed over clean and tidy and in good working order. The holiday-maker is obliged to hand over to the owner or his/her representative the amount due, in EURO (if shown in the local policies in the property description page) for the cleaning of the property. This amount does not, however, include the cleaning of the kitchen corner/the kitchen/the kitchenette such as dirty dishes etc. or the removal of rubbish, which is the holiday-maker’s responsibility. If this has not been done, the owner or his/her representative is obliged to charge an additional expense in addition to the amount due.
If no cleaning cost is foreseen, the holiday-maker must leave the property clean and tidy. If the property is not handed back in the above-mentioned condition, the holiday-maker must pay the owner or his/her representative on the spot the amount necessary for cleaning the property.
HEATING
The use of heating (when it can be switched on and off, temperature, etc.) is controlled by regulations which vary from region to region. As an example, in some regions heating appliances may be switched on only between November and April. Consequently, the heating, even when the cost is included in the letting price, can only be used during the same period. The cost of heating, when is not already included in the price at the time of booking and is based upon usage, must be paid directly on the spot to the owner or his/her representative before departing.
EXTERNAL MAINTENANCE
The owner or his representative reserves the right to have free access to the property for essential maintenance purposes (garden, swimming-pool etc…).
RESPONSIBILITY
If, for any reason beyond its control including force majeure, MIG SOL has to cancel the booking made by the holiday-maker, MIG SOL, in agreement with the holiday-maker, will offer the holiday-maker another property of equivalent standard and price, provided that MIG SOL is able to provide this solution. If the price of the alternative property is lower, the difference will be reimbursed to the holiday-maker by MIG SOL.
In the event that an agreement cannot be reached, both parties can retract from the contract and MIG SOL will reimburse the holiday-maker for the amount paid to MIG SOL in connection with the booking.
The descriptions appearing on the web pages are accurate and have been prepared in good faith. MIG SOL, however, declines all responsibility for any modifications made by the owners without its knowledge, unless it is impossible to totally or partially fulfil the contract and that the holiday-maker will not accept the partial fulfilment of the contract.
WHAT TO DO IF AN ISSUE ARISES
In the event of any problems, the holiday-maker undertakes to do his best to resolve or minimise them in order to avoid any prejudices that could result. If the holiday-maker is unable to do this, they must immediately get in touch with MIG SOL at the phone number listed on the voucher on the day of arrival or within the end of the first next working day, confirming complaints in writing within 24 by e-mail to info@mig-sol.com . The holiday-maker is obliged to give MIG SOL the time necessary to resolve the problem. Should there be no written complaint supplied as above specified and without an explicit authorisation by MIG SOL, the holiday-makers who leave their accommodation prematurely forfeit their rights for a refund of the rental price, unless there is a legal right for them to have cancelled. Complaints received at the end of the stay will not be taken into consideration and no refunds will be given.
IMPORTANT INFORMATION FOR ALL HOLIDAY-MAKERS
As you are aware, most of the properties that MIG SOL offers are not official tourist structures, such as hotels, residences, etc. but private houses. Being such, they do not have standards or categories that are internationally recognised, indeed they reflect, in their architecture and furnishings, the local traditions and the personal taste of the owner.
This is precisely the kind of holiday that MIG SOL offers: the chance to partake in the culture of the area chosen, living for a few days or weeks in the same surroundings as an inhabitant would. In order to live this experience in the right spirit, it is important not only that the holiday-maker accepts but also that they will be able to appreciate the differences in the properties MIG SOL is proposing in comparison with those where they normally live. For its part, MIG SOL has carefully chosen such properties using a minimum and maximum quality range within which it believes that any European and, indeed, any citizen of the world can find total satisfaction. MIG SOL cannot, however, exclude the possibility that these differences can sometimes result in minor inconveniences – due to the special nature of its architecture and of traditions in the area – but which cannot be accepted as complaints.
Any extra services and events (for example chef dinners, cooking lessons, wedding parties) that renters would like to arrange on the property grounds need to be authorized in advance by the property owners.
PAYMENT METHODS AND RELATIVE TERMS AND CONDITIONS
You can use various payment methods to pay for your reservations on MIG SOL websites. Each payment method is governed by separate terms and conditions. Accepting these MIG SOL reservation policies you are also accepting all the terms and conditions of any third parties’ payment tool or services linked here below.
To pay with Debit and Credit cards, Diners, Bancontact, Paylib, Sofort and Giropay through MangoPay that is the Integrated Payment Service, you must agree to the Payment Service Provider’s terms and conditions.
By selecting the PayPal payment type, you will be redirected to a page on the PayPal site where you will enter your email address and password or use one of the supported credit cards and make the payment. Your financial data will not be shared with MIG SOL but will be handled directly by PayPal.
LAW AND JURISDICTION
This agreement is between the holiday-maker (i.e. the renter) and the agency or property owner. MIG SOL is acting only as a representative of the agency or owner listed on the voucher and, as such, cannot be held directly responsible for any problems concerned with the stay. The owners of MIG SOL Limited, its employees, and its agents shall not be liable for any damage, theft, losses or personal injury which may be sustained by the holiday-maker and their companions at any point throughout their stay. Furthermore, MIG SOL shall not be liable in the event of these cases:
-actions or omissions on the part of the renter or on the part of their companions using the services;
-unforeseeable or unavoidable omissions by third parties not involved in the rendering of the contractual services;
-unavoidable, out-of-the-ordinary circumstances or events that neither MIG SOL nor its support staff can foresee despite their diligence;
– the use of swimming pools, playgrounds, and sports facilities of all kinds. The use of such facilities is done at one’s own personal risk;
– damage and loss due to burglary;
– public access roads that could cause damage or injury to things or people.
Bookings made through MIG SOL can be made via website, email or telephone. In the event of controversies arising from the booking process, the Irish Court only can deal with the matter and only Irish law applies. Completing the booking process and accepting the reservation policies implies that these conditions have been understood and have, thereby, been accepted without exception.
If any provision of these reservation policies is, or becomes, invalid, unenforceable, or non-binding, the holiday-maker shall remain bound by all other provisions hereof. In such event, MIG SOL will replace the aforementioned clause with a clause that is valid and binding, has an effect that is as similar as possible to the one replaced, and that the holiday-maker undertakes to accept in respect of the contents and purposes of the present reservation policies.
Any and all issues regarding the property, such as damages, equipment malfunction, injury, etc, which may occur during the stay shall be a dispute between the owner or agency and the renter of the property. In such cases, with no exceptions, the law enforced in the place where the structure is located will apply, and the jurisdiction will be the local courts.
Any problems or complaints associated with the presence or absence of a strong internet or WIFI connection in the property and the use that this entails by the holiday-maker, always falls within the typology for which resulting disputes will only be between the owner of the structure and the holder of the reservation.
The original English version of these reservation policies may have been translated into other languages. The translated version is a courtesy and unofficial and the holiday-maker cannot derive any rights from the translated version. In the event of a dispute about the contents or interpretation of these reservation policies or inconsistency or discrepancy between the English version and any other language version of these reservation policies, the English language version to the extent permitted by law shall apply, prevail and be conclusive. The English version is available on MIG SOL Websites (by selecting the English language) or shall be sent to the holiday-maker upon written request.
